KOMPAS RENT A CAR

General Terms and Conditions of the Rental Agreement

Terms and conditions

Translation of the Croatian text. The Croatian text governs the interpretation of the agreement.

1. Delivery and collection

1.1.

The rented vehicle will be delivered in good condition, with a full fuel tank, all vehicle documents and keys and, unless otherwise provided in the Rental Agreement, without visible external damage. On delivery, the renter/driver must check:

  • that the vehicle has been delivered without visible damage;
  • that all visible damage is recorded in the designated section of the Rental Agreement;
  • the amount of fuel in the tank.

1.2.

After inspecting the vehicle, the renter/driver and the KOMPAS RAC representative will confirm its condition by signing the Vehicle Condition Report.

2. Authorised driver

Only an authorised driver may drive the rented vehicle. Authorised drivers must be signatories to the Rental Agreement and be listed in it as authorised drivers. Authorised drivers may not drive under the influence of alcohol, medication or opiates, or in any condition that may adversely affect their reactions, for example fatigue or illness.

3. Voucher validity, rental period and possible additional charges

3.1.

Voucher validity: the voucher is valid for the number of days stated on it, with each day lasting 24 hours from the vehicle collection time. An overrun of 60 minutes or more incurs a charge of 1/3 of the daily rental rate; an overrun of 120 minutes incurs 2/3 of the daily rental rate; and an overrun of more than 180 minutes incurs one additional rental day. The amount is charged to the renter/driver's credit card.

3.2.

The daily rental rate applies to a period of 24 hours from delivery of the vehicle. An overrun of more than 60 minutes incurs a charge of 1/3 of the daily rental rate; an overrun of 120 minutes incurs 2/3 of the daily rental rate; and an overrun of more than 180 minutes incurs one additional rental day. The amount is charged to the renter/driver's credit card.

3.3.

Fuel cost: the KOMPAS RAC rental rate includes oil and servicing but does not include fuel. If the vehicle is returned with less fuel than at collection, the renter/driver pays for the difference according to the KOMPAS RAC price list, at EUR 3 + VAT per litre. The KOMPAS RAC representative and the renter/driver check the fuel level and confirm it by signing the Vehicle Condition Report.

3.4.

Airport collection surcharge: an additional EUR 20 + VAT is charged when collecting the vehicle at a KOMPAS RAC airport office.

3.5.

Reservations can be confirmed only for a vehicle category, not for a specific vehicle type.

3.6.

Mileage is charged if stated in the Rental Agreement. The renter/driver will be informed of this possibility when collecting the vehicle.

3.7.

The surcharge for reservations or agreements made outside opening hours is EUR 12.20, including VAT, for all reservations or agreements made outside the office's opening hours.

3.8.

By signing the Rental Agreement, the renter/driver accepts that KOMPAS RAC is not liable for the consequences of failure to deliver the vehicle or of vehicle unavailability during the rental period.

3.9.

By signing the Rental Agreement, the renter/driver undertakes to pay all charges arising from breaches of the law and parking during the rental. The renter/driver accepts that KOMPAS RAC may charge these costs to their credit card on the date such claims are received.

4. Compulsory insurance

All vehicles rented from KOMPAS RAC include third-party liability insurance. This insurance is required by law and protects the renter/driver and other authorised drivers against liability arising from the death or injury of other persons.

Third-party liability insurance does not cover loss of or damage to the rented vehicle. The renter/driver is liable for the value of the vehicle irrespective of fault, subject to the optional insurance accepted.

5. Optional insurance

5.1.

The renter/driver must return the vehicle to KOMPAS RAC in the same condition as on collection, with the exception of normal wear and cleanliness. If the vehicle is stolen, lost or damaged, the renter/driver is fully liable for the costs and loss suffered by KOMPAS RAC, irrespective of fault. This includes towing, repair and storage costs.

If the renter/driver selects CDW and/or TP limitation of liability, 'YES' is entered in the designated place in the Rental Agreement. Liability will be limited to an amount reduced in accordance with the KOMPAS RAC price list. This amount, depending on the vehicle model, will be stated in the Rental Agreement.

5.2.

CDW — collision damage waiver: this applies to damage to the rented vehicle, its parts and equipment caused by a traffic accident. CDW limits the renter/driver's financial liability to the excess amount stated in the Rental Agreement.

CDW does not cover damage to the vehicle interior, tyres, wheels or underbody, broken or lost keys, or fuel contamination, whether caused intentionally or through negligence. Such damage is charged in full to the renter/driver's credit card, irrespective of fault, according to the dealership's official price list in force at the time of inspection.

On return, the KOMPAS RAC representative and the renter/driver inspect the vehicle and compare its condition with that recorded in the Vehicle Condition Report at the start of the rental. All changes are entered in the report and confirmed by both parties' signatures.

If the renter/driver does not sign the Vehicle Condition Report but completes the Damage Report, they accept the owner's official assessment of disputed damage.

5.3.

TP — theft protection/waiver: this applies to loss of the rented vehicle, its parts and equipment, including tyres, the audio system and similar items, resulting from theft or attempted theft. TP limits the renter/driver's financial liability to the excess amount stated in the Rental Agreement. TP is invalid if the vehicle is left unlocked or the keys are left unattended inside it.

5.4.

SCDW — super collision damage waiver: by accepting SCDW, the renter/driver bears no financial liability for damage to the vehicle, its parts and equipment resulting from an accident, theft or attempted theft.

SCDW does not cover damage to the vehicle interior, tyres, wheels or underbody, broken or lost keys, or fuel contamination, whether caused intentionally or through negligence.

Such damage is charged in full to the renter/driver's credit card, irrespective of fault, according to the company's official price list in force at the time of inspection. A police report is mandatory for every instance of damage.

On return, the KOMPAS RAC representative and the renter/driver inspect the vehicle and compare its condition with that recorded in the Vehicle Condition Report at the start of the rental. All changes are entered in the report and confirmed by both parties' signatures.

If the renter/driver does not sign the Vehicle Condition Report, they accept the owner's official assessment of disputed damage.

5.5.

Baggage insurance is not available. KOMPAS RAC's liability for lost or damaged belongings left in the rented vehicle is excluded by law.

6. Procedure following an accident, damage, loss or theft

In the event of an accident, damage, loss or theft, the renter/driver must:

  1. immediately notify the police and KOMPAS RAC, follow their instructions and record all details of other persons involved in the accident;
  2. complete an accident or damage report when returning the vehicle;
  3. prepare a brief written account of the incident when returning the vehicle.
